to an end in a few hours. san jose's trace elementary school opening its doors to show off brand new classrooms for the first time since an arson fire left the school seriously damaged. bob redell is live in san jose with a look at the grand i guess call it reopening ceremony. good morning. >> reporter: good morning to you, jon. for the past two years many of the students here at trace elementary school have had to attend class in temporary structures, but starting no more in a few hours the school will dedicate what you're looking at, this beautiful brand new building. it replaces the structures destroyed 18 five-alarm fire two years ago that gutted a huge part of the school, causing $10 million of damage. since it happened july 5th of 2010, the fire department first thought it might have been started by fourth of july fireworks. but sooniz lirealized it was ar.

two boys confessed to police and at least one is serving time in prison. the ribbon cutting with the entire school, 1200 students and teachers, here at the new building we're at now, along with parents and people from the school district, that ribbon cutting and dedication scheduled to happen 18 few hours around 8:30 this morning. bob redell, "today in the bay." >> 5:02. three suspects are behind bars and police are searching for three more following a robbery. at least six men robbed the jewelry store on main street in downtown vacaville yesterday morning. one suspect held the lone employee at gunpoint while the others took merchandise. police say the three men arrested are san francisco residents. >> a once private san bruno settlement is very public this morning. in fact, we now know how much

pg&e paid to one blast survivor. a court accidentally posted the settlement documents on line revealing the $1.8 million settlement to the teen burn victim. the utility also paid hundreds of thousands of dollars for her attorneys fees. another neighbor who also survived said the settlement amount is not nearly enough and that pg&e is getting off lightly. >> i don't think $1.8 million covers anything that this woman or young woman had to go through. >> the disaster killed eight people and burned dozens of homes in the crest more canyon neighborhood. pg&e will likely spend $455 million on all of the lawsuits. >> the city of sacramento is now going after online retailers who are not paying their taxes. the state is hiring nearly 100 new auditors to collect money from merchants. they will be enforcing a new

state law which adds sales tax to online purchases. officials say the effort could bring in more than $300 million each year. and the state has also been sending letters out to retailers reminding them to start collecting the taxes from their customers. >> new this morning, mexican police now looking for suspects running a pot farm which was hidden behind a prison. a tip led investigators to the operation which was located in a city across the california border. they discovered more than a half acre of marijuana complete with a very intricate watering system. police later ripped up all of the plants and burned them. >> the man behind wikileaks is making another public appearance. julian assange gave an interview to a reporter from venezuela from inside ecuador's embassy in london. he says the swedish government will probably drop its case against him in 6 to 12 months. he has been holed up there for more than two months to avoid

deportation to sweden over sexual assault allegations. ecuador granted him asylum over fears he may be sent to the u.s. to face espionage charges. this is his second public appearance from the embassy balcony a few weeks back. >> saying good-bye to an american hero. a private funeral for astronaut neil armstrong in his hometown of cincinnati, ohio. he was the first man to walk on the moon and to honor him president obama ordering flags to fly at half-staff at the white house, military bases, and u.s. embassies all over the world. armstrong you recall died last week from complications after heart surgery. neil armstrong, an american hero, was 82 years old. >> the storm that was once hurricane isaac has been downgraded to a tropical depression. the slow-moving storm continues to produce heavy rainfall, gusty winds, and the threat of isolated tornados. thousands of people in louisiana

and mississippi are in shelters after heavy flooding and last-minute evacuations. two people are confirmed dead in southern louisiana after their home was swallowed by water. hundreds of thousands who didn't lose their homes still have no power and they likely won't for days. >> still tough down there. 5:06. not as warm as yesterday, going to cool off. >> we're going to cool off inland. it depends on where you're waking up. the microclimates coming into play. 57 degrees right now your temperatures are uniform, but as you know that separation occurs right about at noon, temperatures are only in the upper 50s still in san francisco as we head into the lunch time hour. here in the south bay in particular, we'll be at about 70 degrees at noon, rounding out the day in the upper 70s. just a beautiful forecast for us today. thick low clouds will likely force flight delays out of sfo.

impact your holiday travel. good morning. >> reporter: good morning to you. this isn't what you want to hear on any friday but especially the friday starting a three-day weekend. we're in oakland by the airport where gas price, $4.19. across the street $4.17. the average about $4.15 for regular in california. the average national price for regular unleaded went up 2 cents on wednesday alone. aaa saying hurricane isaac having an impact in some regions, forcing gulf refineries to shut down. some staying put over the weekend. it's still 33 million americans will hit the road and that's up about 3% from last year. i just spoke with one man in oakland who said he's leaving no matter what. >> does that affect you the gas prices trying to go anywhere or considering going anywhere? >> no. i'll still be traveling.

>> right here this is a live shot, plenty of overcast skies to show you in san francisco on this friday morning. christina says expect a cooldown. we'll get the full forecast in a bit. 5:12. >> the defense department could be on the offensive, it's considering legal action against the author of the book detailing the raid that killed osama bin laden. the pentagon's top lawyer has informed the former navy seal who wrote the book that he violated an agreement to not relay military secrets. the author who was part of the team that carried out the raid says bin laden was looking out the window when he was shot in the head.

the author has also been heavily criticized by fellow navy seal who is have long operated under a code of strict secrecy. >> this one is a bit of a shocker from the school, harvard says 125 students may have cheated on a take-home exam. students may have collaborated or copied answers. teachers spent months trying to identify the students that are now under investigation. the test in question was specifically for a course called introduction to congress. >> investors seem to be convince there had is not much future in the online game company zynga. even employees are fleeing the company. scott says there may abturnaround ahead. >> the legalized gambling, no secret zynga is eyeing online poker and other forms of gambling as a way to save the company. we've seen evidence that legal online poker may come to the united states. zynga hired a new high level executive to handle that branch

of the business, we know this after the executive posted his new job on linkedin even before zynga had a chance to tell anyone. shares near a low, yesterday two more vice presidents left the company. earlier this week it lost its chief creative officer, a few weeks ago it lost its chief operating officer as well. >> the man who signed his name to a billion dollar guilty verdict against samsung says he was a reluctant foreman. vel hogan tells nbc bay area only one vote was cast against him when it came time to decide who would lead the jury and it was his vote. >> i really initially had not wanted to be foreman. i was unanimously voted in. the only dissenting vote was mine. so i knew who i voted for.

when i leaned over i said you and i are going to facilitate this together. >> mr. hogan will be one of my guests on press here after "meet the press" on sunday morning. in the meantime, this morning at 7:00, ben bernanke will speak in wyoming, may hint about new fed action. we turn to kayla. good morning. >> good morning, scott. futures in the stock market are higher ahead of that speech and that's after stocks fell on thursday. the dow has lost its gains for august and the nasdaq had its worst day 18 month on jitters over europe and ahead of that key speech this morning. ben bernanke is expected to acknowledge but may not offer more clues ahead of the fed's next meeting in a few weeks. manufacturing, consumer sentiment and factory orders today. the dow dropping 106 to 13,000 t nasdaq to 3048. and mortgage rates have pulled back, halting the gradual rise

through sunday and monday. labor day. it's going to feel like you typically want labor day to feel. you want to hit the beach, you'll be able to. you want to hit the water, that might be a problem. we'll talk about that. we're expecting rough seas. conditions for you to just sit by the beach are going to be fantastic. 57 degrees in san francisco, 55 in novato. temperatures are nice and mild this morning but they are going to be cool. you might have to dust off the sweater or jacket. bring it with you to work as temperatures are on the cool side. especially in san francisco and for your coastal communities. at least the first part of the day. temps should climb out of the upper 50s as we head through about 1:00 today in san francisco. but even with a little bit of a sun break you're not going to get very warm. 60 degrees, that's it today in san francisco. so, with all of that fog you can count on flight delays, we don't have any coming in out of sfo but that's likely the case. and you want to give yourself time traveling down the peninsula. we have reports of drizzle

coming down courtesy of the thick low clouds. look at what the clouds are going to do to the temps. coming down 10 to 15 degrees, that means 79, that's it in livermore. through saturday, temps will be just about as warm as they will be today. a touch warmer. then look at the difference between saturday and sunday. we spike you back up to the upper 90s. labor day, stays hot. 97 inland, 84 degrees bayside and 75 at the coast. i'm talking about half moon bay. so we'll talk more about the beach cities, who is going to get the best weather. this is going to differentiate your plans as you head through the week. let's talk to anthony, forget outdoors just to head to work. >> the accident 101 around palo alto at university city, apparently a couple animals were struck in that location so an ambulance is on the scene clearing that away. so you can see it has slowed a bit. not looking at stop and go traffic. south bay all is clear for the time being and also one thing to

point out, folks coming and going, santa cruz into the mountains it looks like we're seeing slowdown there is so possibly some of that drizzle christina was talking about causing slowdowns and a quick heads up, the dumbarton bridge will be closed beginning tonight at 10:00 tonight, reopening tuesday in time for all of us to go back to work at 5:00 a.m. marla. >> right now it's 5:19. a new school year means adjustments for kids. doctors at los angeles's children's hospital encourage students sleeping at a regular schedule, 8 to 10 hours each night. doctors say creating a sleep schedule will reduce behavior problems and might improve study and homework habits. >> while their children are getting a rest parents are encouraged to pack healthier lunches. many popular foods like sandwich meats and chip kons taken salts

which can create kidney stones in some kids. they want parents to provide more fluids and less processed foods and starting this year public schools are under federal guidelines to reduce calories and salt in lunches they serve. >> the trick is trying to convince kids to eat something beside candy. i find it odd that i have to negotiate with a 3-year-old and what is sad i often -- it's 5:20, a manhunt under way in the bay area, not for a criminal but for the winner of a $52 million lottery ticket. why officials are using security video trying to track him down.

for you. 5:22. >> you know what, he knows he's won millions but has not come forward to claim his prize. lottery officials say this right here is surveillance video of the man buying the $52 million winning mega millions lottery ticket at the quick and convenient liquor market in fremont last month. he has physically checked his ticket several times. but for some reason he has yet to come forward to claim the money. we talked with the cashier who sold him that ticket. >> i know as a customer i know him. he is to come almost every week. >> he has one year from the date of the draw to claim the prize or he will lose all that money. >> people are going to see that video, friends are going to start hitting him up for loans. >> absolutely. >> can i borrow a couple extra bucks? >> like two million. >> check back in with meteorologist christina loren. is it a million dollar forecast?

>> it is, just depends on which day you're looking at. not so much the million dollar bonus in san francisco, you're going to see the give and take throughout the next couple of days so gray skies over the city by the bay for the most part but nonetheless, livermore temperatures will be perfect at 79 degrees. its crisp this morning. as we head throughout the next couple hours we'll see changes, so we'll take you through those changes. we want to look at your morning drive, though, let's get it on over to anthony slaughter, see if there are problems out there on the roads. >> we have 101 moving slowly around foster city but one thing to make mention of, 92 headed in toward half moon bay is slow, there is no report of an accident but it's just a slow go. show you what it looks like headed into foster city. you can see the headlights are on as folks come over the bridge. fog doesn't look like too much of an issue.

friday, a three-day weekend, and how this is impacting them. here we are and gas prices 4.19. across the street it's 4.17. asking folk this might make them sit this out. for many they tell us the answer is no, that if you're determined to enjoy it, you budget it in, maybe a shorter trip but still go. average price in california now $4.15 for a gallon of regular. on wednesday, national price average shot up 2 cents, that's in one day, a number of reasons including hurricane isaac forcing refineries to shut for a time. one man told me it's about your budget and priorities. >> i'll stay home, tiger woods is playing, i never leave home when tiger woods is playing. >> that is important. what do you think when you see 4.19 a gallon? >> that's expensive.

>> reporter: there were a couple of people out here who told us that at this point they can't afford to go anywhere extra and it's been that way for some time. we were looking at the pumps here this morning and i tell you, a lot of people just putting in 10 bucks, 5 bucks, 20 bucks, looks like they are getting enough here to look for the next cheapest station. christie smith, "today in the bay." >> anxious homeowners say they are keeping an eye on a teenager charged with burglarizing two homes and sexually assaulting a neighbor. the suspect justin shing is out on bail and back home less than a block from the home police say he broke into. last night foster city police chief attend add neighborhood meeting to reassure neighbors their safety is a top priority. >> folks' home is their sanctuary. it is the place on earth where we should all feel secure. and the fact that somebody entered while people were home made it that much more serious.

>> neighbors say they understand that the police cannot be there every second so they plan to watch the suspect closely. justin shing is due in court next tuesday where he is expected to enter a plea. >> it is 5:32. pleasanton police are teaming up to identify a woman's body stuffed in a trash can. police released this sketch of the victim in june but so far it has not generated leads. federal investigators now searching data bases of finger prints and dna to try to identify her. dental records are being examined. the woman is likely in her 20s and either asian or hispanic. her death is being investigated as a homicide but so far no cause of death has been determined because the body was just so badly decomposed. the murder trial in the death of michelle le will begin a year to the day. the former nursing student's body was found.

a judge set the date for september 17. just yesterday that same judge denied a motion to exclude some key evidence against the woman accused of killing le. her attorneys claim statements regarding her whereabouts were gathered during an illegal search. >> san jose firefighters still in the hospital recovering after suffering a heart attack while fighting a fire. frank ryan is in critical but stable condition. he was at the fire yesterday when suddenly he collapsed and it was his fellow firefighters there to save his light. registered nurse who works at regional cardiac unit said he was lucky to be with people who knew how to restart his heart. >> we call it sudden death. if it's not restored you can lose the patient. >> he's happy to be alive and

started by fourth of july fireworks but soon realized it was arson. two teenage boys were arrested for starting the the fire. both ended up confessing to police and at least one is serving time in prison. the ribbon cutting will happen with the school, talking about 1200 students and teachers along with parents and people from the school district. this is scheduled for later this morning around 8:30. reporting live in san jose. >> 5:35. many heading to yosemite for the long weekend will be greeted with bad news. the number of hantavirus cases has increased to six. park officials closed nearly 100 signature tent cabins. officials believe campers were in those cabins when they were exposed to the virus. in the past weeks two people have died from the disease and four others recovering.

temperatures dropping off by 10 to 15 degrees from yesterday. so it's not going to be that warm. but it little get hot flew the weekend. first i want to check your drive. >> thank you. we do have an accident around the alta mont pass. two accidents on 280 westbound in dublin at dirty road. there is a big rig that is trying to get to side of theç road because it has broken down there. and in almost again on 580 at greenville, slow because of another accident there, two cars collided. show you what it looks like and you can see from the south bay we do have winds blowing but traffic is still moving and also in the north bay coming in from 101 things are moving along smoothly. >> 5:37. it was mitt romney's night but yeahsh guess what, it was somebody else's chance to steal
